PROBLEMS:
By default, defense counsel for the developer typically controls the defense
cost sharing program.
Each defense firm utilizes a slightly different approach to administering the
defense cost program, which can be confusing and can cause inequities.
Defense counsel is charging the same rates for administering the defense cost
sharing program as they are for the defense of the lawsuit.
Defense counsel’s focus should be directed toward defending their client(s).
Defense counsel should not be controlling the defense cost dollars for the
insurance carriers.
The defense cost sharing program should be administered by the insurance
industry.

Our approach involves every viable insurance carrier who has a duty to defend

After the tender, we work with every insurance carrier representative and will
provide the documentation that is reasonable and necessary for them to make a
decision regarding their defense obligation.
We follow up as necessary to determine the position of every insurance carrier
regarding defense of the developer/general contractor.
We communicate with and involve defense counsel as necessary to avoid
duplication of effort and to achieve our goals. We maintain an open line of
communication with defense counsel so they understand their role in the timely
collection of the defense fees and cost.
We will obtain a litigation budget from defense counsel and the experts to
assist us in developing the defense cost sharing program.
We provide timely and informative reporting to all of the participants in the
program.
We attend mediations and mandatory settlement conferences as necessary to ensure
that all appropriate insurance carriers participate in the defense of the
developer/general contractor.
We also handle the expense billing to the participants in the defense cost
sharing program and our trained staff will follow up as reasonably necessary to
collect from delinquent accounts.
Our staff is capable of analyzing coverage issues and when necessary, will
recommend referring to coverage counsel for an opinion and possible contribution
